1. Acceptance of these terms

These Terms of Use (“Terms”) govern your access to and use of the Boaty Jobs website and services (collectively, the “Service”), operated by Boaty Jobs (“we”, “us”, “our”), a company incorporated in Ireland.

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, and references to “you” include that entity.

3. Your account

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must provide accurate, current, and complete information when registering and keep it up to date.
  • You must notify us immediately at support@boatyjobs.com if you suspect any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

4. Use of the Service

You may use the Service for lawful purposes only. You agree not to:

  • Post false, misleading, defamatory, or discriminatory content.
  • Advertise roles that do not exist, use bait-and-switch tactics, or collect personal data from job seekers for purposes other than the stated vacancy.
  • Use automated scripts, bots, scrapers, or crawlers to access, harvest, or index any part of the Service without our written permission.
  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our infrastructure.
  • Upload or transmit viruses, malware, or any other harmful or malicious code.
  • Use the Service to spam, phish, solicit, or harass other users.
  • Circumvent any security, access control, or technical protection measure on the Service.
  • Use the Service in any manner that violates applicable law, including Irish law, EU law, or the law of your jurisdiction.

5. Job listings and applications

For employers: you are solely responsible for the accuracy, completeness, and legality of any job listing you post. Listings must comply with all applicable employment laws, including the Employment Equality Acts 1998–2015 (Ireland) and the Equal Treatment Directive (EU). Listings that are discriminatory, misleading, or otherwise unlawful will be removed without notice and without refund.

For job seekers: you are responsible for the accuracy of the information you provide in your profile and in any job application, including your CV and cover letter. Misrepresentation in an application may result in termination of your account.

Boaty Jobs is a platform connecting employers and job seekers. We are not a party to any employment contract or relationship arising from use of the Service, and we make no guarantee that any listing will result in employment.

6. User content

By submitting content to the Service (including CVs, cover letters, profile information, and Crewfinder profiles), you grant Boaty Jobs a non-exclusive, worldwide, royalty-free licence to store, display, and process that content solely for the purpose of providing and improving the Service.

You retain full ownership of your content. You represent and warrant that you own or have the necessary rights to the content you submit, and that it does not infringe any third-party intellectual property rights.

7. Intellectual property

The Boaty Jobs name, logo, website design, text, graphics, and all other content (excluding user-submitted content) are owned by or licensed to Boaty Jobs and protected by Irish and EU intellectual property law. You may not reproduce, copy, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Third-party links and services

The Service may contain links to third-party websites or integrate with third-party services (such as Stripe for payments). These are provided for your convenience only. We have no control over, and accept no responsibility for, the content, privacy practices, or availability of third-party websites or services. Your use of any third-party service is subject to that party's own terms and privacy policy.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or suitability of any job listing or any information on the Service.

10. Limitation of liability

To the fullest extent permitted by Irish law, Boaty Jobs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising from or in connection with your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amounts paid by you to us in the 12-month period preceding the event giving rise to the claim, or €100 (whichever is greater). Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Boaty Jobs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Suspension and termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have violated these Terms or applicable law.

You may delete your account at any time using the “Delete my account” option in your account settings. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) shall continue in full force.

13. Changes to these Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email to registered users or by posting a prominent notice on the Service. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.

14. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict-of-law provisions.

In the event of any dispute arising from or in connection with these Terms or your use of the Service, we encourage you to contact us first at support@boatyjobs.com so we can attempt to resolve the matter informally.

If the dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts of Ireland. If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence under EU consumer protection law.
